Pokhara—The hearing on the dissolution of the House of Representatives is undergoing in the constitutional bench of the Supreme Court of Nepal. The bench chaired by Chief Justice Choendra Shumsher JB Rana includes the other four justices- Deepak Kumar Karki, Dr. Aanand Mohan Bhattarai, Tej Bahadur KC, and Bam Kumar Shrestha.
President Bidya Devi Bhandari dissolved the House of Representatives as per Article 76- 7 of Nepal’s Constitution on May 22, citing that the two claims staked by ruling CPN-UML Chairman and incumbent Prime Minister KP Sharma Oli and main opposition Nepali Congress Chairman Sher Bahadur Deuba were incomplete and grasp no reliable basis to appoint them a new PM in line with Article 76-5 of Nepal’s Constitution.
As President Bhandari quashed those claims and dissolved the House of Representatives and announced the poll date, 146 former lawmakers from NC, CPN-MC, a faction from Janata Samjbadi Party, and ruling CPN-UML filed a writ petition in the Supreme Court, seeking the restoration of dissolved HoR and the appointment of Sher Bahadur Deuba as new PM as per Article 76-5. As many as 30 writ petitions have been lodged in the Supreme Court to appoint a new PM to Deuba and Oli.
In his preliminary single bench hearing, CJ Rana denied issuing interim order over the writs but ordered to send them to the Constitutional Bench that was formed by Rana and now is having the hearings over those writes. Previously, President Bhandari in the recommendation of PM Oli’s cabinet meeting had dissolved the HoR but the Supreme Court had reinstated it on Feb 23, 2021.
